These Terms and Conditions (“Terms”) govern your use of the SMS/text messaging notifications (“SMS Service”) provided by Emerge SWFL (“Emerge SWFL,” “we,” “us,” or “our”). By enrolling in or using our SMS Service, you agree to these Terms, as well as our Privacy Policy.

Program Description

The Emerge SWFL SMS Service provides non‑marketing, transactional text messages related to our services, including but not limited to:

  • Appointment confirmations and reminders

  • “On the way” and arrival notifications

  • Service status updates and follow‑up messages

Messages are sent only in connection with services you request or receive from Emerge SWFL. The SMS Service does not send promotional or advertising text messages.

By providing your mobile phone number to Emerge SWFL and opting in (such as by requesting SMS notifications on a web form, over the phone, or in person), you:

  • Confirm that you are the owner or authorized user of the mobile number provided.

  • Consent to receive SMS/text messages from Emerge SWFL at that number related to your services and appointments.

Your consent to receive SMS messages is not a condition of purchasing any goods or services, and you may opt out at any time as described below.

Message Frequency

Message frequency will vary depending on your level of interaction with Emerge SWFL, such as scheduling, updating, or completing services.

  • You may receive multiple messages around scheduled appointments (confirmation, reminder, “on the way,” and follow‑up).

  • You will not receive recurring marketing or promotional campaigns via SMS.

Message and Data Rates

Message and data rates may apply to any SMS/text messages sent to or received from Emerge SWFL, depending on your mobile carrier and plan.

  • You are responsible for any charges from your mobile carrier for text messaging and data usage.

  • Check your mobile plan and contact your carrier for details about your text messaging rates and fees.

How to Opt Out

You can stop receiving SMS/text messages from Emerge SWFL at any time:

  • Reply STOP to any text message you receive from us.

After you send STOP, you may receive a one‑time confirmation message to verify that you have been unsubscribed. After that, you will no longer receive SMS messages from Emerge SWFL, except as required for important service or legal notifications if applicable.

If you change your mobile number or no longer wish to be associated with the number on file, it is your responsibility to opt out and/or contact us to update your contact information.

Participating Carriers

Our SMS Service is supported by most major U.S. wireless carriers; however, availability may vary by carrier and geographic area.

  • Delivery of messages is subject to effective transmission by your mobile carrier and is outside of Emerge SWFL’s control.

  • Emerge SWFL is not liable for delays or failures in message delivery.

Mobile Number and Data Privacy

Your use of the SMS Service is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal information, including your mobile number.

  • Emerge SWFL does not sell, rent, trade, or share your mobile number with third parties for their own marketing purposes.

  • Your number is used only to deliver reminders and notifications related to your services and to operate the SMS Service.

Restrictions and User Responsibilities

By using the SMS Service, you agree:

  • Not to use the SMS Service for any unlawful, abusive, or fraudulent purpose.

  • To provide accurate, current mobile contact information and update it as needed.

  • That you are at least 18 years old, or using the service under the supervision of a parent or legal guardian.

Emerge SWFL may suspend or terminate your access to the SMS Service at any time if misuse, abuse, or violation of these Terms is suspected.

Disclaimer of Warranties

The SMS Service is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied.

  • Emerge SWFL does not warrant that the SMS Service will be uninterrupted, timely, secure, or error‑free.

  • To the maximum extent permitted by law, Emerge SWFL disclaims all warranties relating to merchantability, fitness for a particular purpose, and non‑infringement.

Limitation of Liability

To the fullest extent permitted by law:

  • Emerge SWFL will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the SMS Service.

  • Emerge SWFL’s total liability for any claim related to the SMS Service will not exceed the amount you paid (if any) for using the SMS Service.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Emerge SWFL, its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the SMS Service or your violation of these Terms.

Changes to These Terms

Emerge SWFL may update or modify these Terms at any time.

  • Changes will be posted on this page with an updated “Last updated” date.

  • Your continued use of the SMS Service after any changes are posted constitutes your acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the SMS Service and opt out as described above.
